Subject matter主旨

1.This Regulation lays down the requirements for the design and manufacture of unmanned aircraft systems (‘UAS’) intended to be operated under the rules and conditions defined in Implementing Regulation (EU) 2019/947 and of remote identification add-ons. It also defines the type of UAS whose design, production and maintenance shall be subject to certification. 本法规规定了在实施法规(EU) 2019/947中定义的规则和条件下操作的无人机系统(“UAS”)和远程识别附件的设计和制造要求。它还定义了无人机的类型，其设计、生产和维护必须经过认证。

2.It also establishes rules on making UAS intended for use in the ‘open’ category and remote identification add-ons available on the market and on their free movement in the Union. 它还制定了一些规则，使“开放”类别的无人机和远程识别附加组件在市场上可用，并在联盟内自由移动

Scope 范围

1.Chapter II of this Regulation applies to the following products: 本条例第二章适用于下列产品:

(a) UAS intended to be operated under the rules and conditions applicable to the ‘open’ category of UAS operations pursuant to Implementing Regulation (EU) 2019/947, except privately built UAS, and bearing a class identification label as set out in Parts 1 to 5 of the Annex to this Regulation indicating to which of the five UAS classes referred to in Implementing Regulation (EU) 2019/947 it belongs to; 根据实施法规(EU) 2019/947，无人机计划在适用于“开放”无人机操作类别的规则和条件下操作，私人建造的无人机除外，并带有本法规附件第1至5部分中所列的类别标识标签，表明其属于实施法规(EU) 2019/947中提到的5个UAS类别中的哪一个

2.Chapter III of this Regulation applies to UAS operated under the rules and conditions applicable to the ‘certified’ and ‘specific’ categories of UAS operations pursuant to Implementing Regulation (EU) 2019/947. 本法规第三章适用于根据实施法规(EU) 2019/947，在适用于“认证”和“特定”无人机操作类别的规则和条件下操作的无人机。

3.Chapter IV of this Regulation applies to UAS operators that have their principal place of business, are established, or reside in a third country, if the UAS are operated in the Union. 本法规第四章适用于主要营业地在第三国建立或居住的无人机系统运营商，如果无人机系统是在欧盟运营的

4.This Regulation does not apply to UAS intended to be exclusively operated indoors. 规定不适用于仅在室内操作的无人飞行系统。

 

Definitions 定义

For the purposes of this Regulation, the following definitions apply: 就本规例而言，下列定义适用:

(1) ‘unmanned aircraft’ (‘UA’) means any aircraft operating or designed to operate autonomously or to be piloted remotely without a pilot on board; ：“无人驾驶飞机”(“UA”)指自动操作或设计为自动操作或无人遥控驾驶的任何飞机;

(2) ‘equipment to control unmanned aircraft remotely’ means any instrument, equipment, mechanism, apparatus, appurtenance, software or accessory that is necessary for the safe operation of a UA other than a part and which is not carried on board that UA; “远程控制无人机的设备”是指任何仪器、设备、机械、仪器、附件、软件或附件，除部件外，为UA的安全运行所必需的，且该UA并未携带在该UA上;

(3) ‘unmanned aircraft system’ (‘UAS’) means an unmanned aircraft and the equipment to control it remotely; “无人飞机系统”(“UAS”)指无人飞机及其远程控制设备;

(4) ‘unmanned aircraft system operator’ (‘UAS operator’) means any legal or natural person operating or intending to operate one or more UAS; “无人机系统操作员”(“UAS操作员”)指操作或打算操作一个或多个无人机的任何法人或自然人;

 

 

Conformity assessment procedures 合格评定程序（CE认证程序）

1.The manufacturer shall perform a conformity assessment of the product using one of the following procedures with a view to establishing its compliance with the requirements set out in Parts 1 to 6 of the Annex. The conformity assessment shall take into account all intended and foreseeable operating conditions. ：生产商应使用下列程序之一对产品进行符合性评估，以确定其符合附录第1至6部分规定的要求。合格评定应考虑到所有预期和可预见的运行条件。

2.The procedures available to conduct the conformity assessment shall be the following: 可用于进行合格评定的程序应如下:

(a) internal production control as set out in Part 7 of the Annex, when assessing the compliance of a product with the requirements set out in Parts 1, 5 or 6 of the Annex, subject to the condition that the manufacturer has applied harmonised standards, the references of which have been published in the Official Journal of the European Union, for all the requirements for which such standards exist; 内部生产控制在附件的第7部分,当评估一个产品的合规与1中列出的要求部分,附件5或6,服从制造商应用协调标准的条件,它的引用已发表在欧盟的官方杂志,适用于这些标准所适用的所有要求;

(b) EU-type examination followed by conformity to type based on internal production control as set out in Part 8 of the Annex; 根据附件第8部分中规定的内部生产控制，进行eu型式检验，然后进行型式符合性检验;

(c) conformity based on full quality assurance as set out in Part 9 of the Annex, excepted when assessing the compliance of a product which is a toy within the meaning of Directive 2009/48/EC. 根据附件第9部分所载的全面质量保证符合性，但在评估属于指示2009/48/EC所指的玩具的产品符合性时除外
